The bridge to someone else’s land

The footbridge, which connects to nothing.

The Dutch railway infrastructure operator ProRail is waging a war on the level crossing. They want to eradicate all level crossings. Near Baarn, they have built a footbridge to be able to close three nearby unprotected level crossings.

This footbridge does not connect to any path. Next to it is a level crossing, still open to the public.

ProRail voert een oorlog tegen de overweg. Ze willen alle gelijkvloerse overwegen verwijderd hebben. In de buurt van Baarn hebben ze een voetbrug gebouwd, zodat 3 nabije onbewaakte overwegen gesloten kunnen worden.

Er is alleen geen voetpad naar de brug toe. Naast de brug ligt een overweg, nog steeds open voor het publiek.

In the Netherlands, the NS is the state-owned major railway operator. In the olden days, it was responsible for running trains and keeping the rails in top-notch condition.

In 2003, those tasks were split: NS still runs trains (and sells coffee on stations), but ProRail became the rail infrastructure operator: they inherited the rails and everything close to that, such as the ground under the rails, bridges, platforms etc.

However, the NS is still owner of many “objects” that are not part of the mainline railways, among which many plots of land close to but not directly under the railways. The NS aquired these plots, usually in the 19th century, when seeking rights-of-ways for those railways, and often could not sell the remaining parts of plots, or they didn’t care to. In 2010, they auctioned off these plots of “remainder land” and the highest bidder was a company called Rail Side BV. Rail Side bought 1300 parcels, totalling 1200 ha, and is the largest “neighbour” of ProRail.

The reasons for wanting to own all this land are speculative – indeed, because land speculation is probably the main motive of Rail Side. Rail Side is sister of a real estate agency, and was founded with as goal “aquiring ownership of land next to rail lines”[1].

In Nederland is NS de grootste spoorwegonderneming. Vroeger was NS verantwoordelijk voor het rijden van treinen en het onderhoud van het spoor. In 2003 werden deze taken opgesplitst: NS rijdt nog steeds treinen (en verkoopt koffie op stations), maar ProRail werd de infrastructuurbeheerder: zij orven de rails en alles daarbij in de buurt, zoals de grond onder de rails, bruggen, perrons etc.

De NS is nog steeds eigenaar van vele “objecten” die geen onderdeel zijn van de hoofdspoorwegen, waaronder vele percelen land dicht bij, maar niet onder de spoorwegen. De NS heeft deze percelen vaak al in de 19e eeuw vergkregen toen ze grond voor het tracé van de spoorwegen aankochten, en vaak konden ze de reststukken land niet verkopen, of deden ze er geen moeite voor. In 2010 zijn deze percelen “restland” geveild; de hoogste bieder was Rail Side BV. Rail Side heeft 1300 percelen van in totaal 1200 ha gekocht, en is de grootste “buurman” van ProRail.

Naar wat Rail Side wil met al dit land kan ik slechts speculeren – maar ik vermoed dat grondspeculatie het hoofdmotief van Rail Side is. Rail Side is zuderbedrijf van een vastgoedonderneming, en is opgecicht met als doel “de verwerving van gronden nabij spoorlijnen.”[1].

Back to the bridge near Baarn. Rail Side is the owner of the plots of land neighbouring ProRail’s (see plan below), which can not be much wider than two meter on the south side, or half that on the north side. Rail Side does not allow a footpath to be built over it’s thin slices of land. At least, not until ProRail hands out some money – not an ungodly amount, something in the order of a few thousand euro. And many hundreds of thousands of euros for the previous times ProRail built on Rail Side’s land. [2]

ProRail and Rail Side have a blanket contract on the sale of plots of land needed by ProRail, but ProRail — according to Rail Side — keeps negating this agreement. On this occasion, Rail Side is fed up with ProRail and requires hard cash for the 25 m2 of land needed for the footpath, and for in total 550 ha of other land ProRail used without compensation [3] . ProRail built the bridge (which itself is on land owned by ProRail) anyway, because they had already contractors ready and shut down the rail line. The bridge was erected on september 26, 2015 [2].

The footpaths connecting to the bridge can not be built over Rail Side’s land until this conflict is solved, rendering the bridge unusable and thus a citrastructuræ.

Terug naar de brug in Baarn. Rail Side de eigenaar van de naburige percelen land van ProRail (zie boven), die niet meer dan 2 meter breed kunnen zijn ten zuiden van het spoor, en minder dan een meter ten noorden. Rail Side wil niet dat ProRail een voetpad op haar smalle strookjes land bouwt. Tenminste, niet totdat Prorail wat geld ophoest — geen onoverkomelijk bedrag, slechts enkele duizenden euro’s. En vele honderduizenden euros voor de vorige keren dat ProRail op land van Rail Side heeft gebouwd. [2]

ProRail en Rail Side hebben een raamovereenkomst over de aankoap van percelen die ProRail nodig heeft, maar ProRail blijft — volgens Rail Side — deze overeenkomst negeren. Rail Side is het nu zat en wil harde cash voor de 25 m2 land die nodig is voor het voetpad naar de brug, en voor de in totaal 550 ha ander land dat ProRail gebruikt heeft zonder vergoeding [3]. ProRail heeft de brug (die wel op land staat dat van ProRail is) toch gebouwd, omdat ze al aannemers hadden ingeschakeld en de spoorlijn hadden stilgelegd. Op 26 september 2015 is de brug geplaatst [2].

De voetpaden naar de brug kunnen niet over het land van Rail Side gelegd worden tot het conflict is opgelost, waarmee de brug ongebruikt is en dus een citrastructuræ is geworden.

 

Update

An openstreetmap contributor changed the bridge from “under construction” to “in use”. Apparently, he found the bridge to be open on december 2nd, 2015.

Een openstreetmap-gebruiker heeft de brug van “in aanbouw” naar “in gebruik” omgezet. Hij trof de brug in bruikbare toestand aan op 2 december 2015.
